๐ Texas Hemp Ban: A Step Backwards for Patients, Progress, and Common Sense
At Prohibition 37, we believe in the power of cannabis — not just as a product, but as a movement for justice, healing, and scientific integrity. That’s why we’re watching closely — and speaking out — as Texas prepares to enact Senate Bill 3, a sweeping ban on all hemp-derived THC products, including Delta-8, Delta-9, THCA, and others.
If signed into law by Governor Greg Abbott, the bill would go into effect September 1, 2025, wiping out a legal, thriving industry and leaving tens of thousands without safe access to the medicine they rely on.
Let’s break it down — and talk about what this means for the future of cannabis and compassionate care.
“I think it's important to highlight the burden that hemp could alleviate from this country agriculturally. As we focus on regulations and so forth, we don't want hemp to become overregulated to the point it cannot be used as an agricultural product.”
— Gabrielle Ballentine, Director of Wholesale, Prohibition 37
๐ฅ What’s Actually Being Banned?
SB 3 targets intoxicating cannabinoids derived from hemp, including:
-
Delta-8 THC
-
Delta-9 THC
-
THCA
Even if they’re chemically identical to the compounds in regulated cannabis, under this law, these products would be prohibited to manufacture, sell, or possess in Texas.
Only CBD and other non-intoxicating cannabinoids would remain legal.
๐ฅ Who Does This Hurt?
Patients. Farmers. Small businesses.
This law would eliminate access to affordable therapeutic products for people managing:
-
Chronic pain
-
PTSD
-
Nausea
-
Anxiety
-
Cancer treatment side effects
And it threatens an estimated $8 billion hemp industry in Texas, which supports 50,000+ jobs and 8,000+ licensed operators.
๐งช Prohibition in a Lab Coat
This isn’t a move for safety — it’s a retreat into fear and misinformation. Rather than improve quality control and education, Texas lawmakers are shutting the door on a scientifically legitimate, federally compliant agricultural sector.
๐งญ What’s Next?
There are signals that Texas may expand its medical cannabis program, but that’s a slow path for many patients in urgent need. Without thoughtful transition or access, this ban does more harm than help.
✊ Where We Stand
At P37, we stand for:
✅ Patient access
✅ Regulated innovation
✅ Evidence-based policy
✅ Respect for cannabis as medicine and agriculture
We urge Governor Abbott to veto SB 3 and instead support legislation that uplifts patients, small businesses, and the agricultural community — not crushes them.
๐ข Stay tuned for more updates. We’ll continue fighting for what’s right — in Texas and beyond.
